MSELECT is looking to hire a Senior Contract Engineer for an international oil and gas client in Erbil, candidates must have a very extensive experience in procurement processes including: ethical principles; bidder qualification; invitation to tender; comparative evaluation of contractors, fluency in English is a must.

 

Job purpose

  • Conducting the job in a way that best optimizes Company’s HSE performance, reputation and profitability
  • Ensuring and/or verifying that all activities to which the job-holder is assigned are conducted in accordance with the Company policies and procedures reporting any non-conformities to line management
  • Proactively managing a portfolio of work assignments and reporting any issues that may have an adverse effect on affect performance, to line management

Responsibilities

  • Promote the Contracts function as a managed process which requires timely input from technical departments
  • Act as focal point with specialist/dedicated client group(s), operating with technical counterpart(s), to proactively facilitate, contract planning and management
  • Actively follow relevant markets, gathering and using information received, and developing and maintaining market information systems to provide up-to-date details of both market conditions and contractors/suppliers
  • Proactively build and maintain relationships with suppliers and service providers in order to secure positive, constructive and cost-effective commercial agreements for the Company
  • Establish contracting strategy with to serve and protect Company’s best commercial interest
  • Review and consider legal aspects associated with contract award and administration, liaising with the Legal Department, providing advice to clients as appropriate and assisting as appropriate in settlement of law suits
  • Propose, per-qualify and recommend suitable contractors/suppliers for bid lists to maximize tendering efficiency and in accordance the Production Sharing Agreement requirements
  • Compile issue and administer ‘Invitation to Tender’ packages to procure the most realistic and commercially attractive proposals from potential contractors/suppliers. (This includes reviewing and compiling the technical part of the ITT package based on input received from Technician and providing commercially relevant advice)
  • Draft appropriate contractual and commercial terms and conditions to best serve and protect Company’s interests
  • Review bids, participate in clarifications, conduct negotiations and administer the award of contracts and contract amendments and provision of feedback to bidder
  • Ensure all contracting activities meet audit requirements in compliance with Company policies and procedures and Kurdistan legislation in order to minimize any potential partner/audit claims or court actions
  • Monitor contractors’ performance, promoting and attending service quality meetings, recording results and participating in supplier relationship management supplier performance management activities
  • Provide general assistance and advice on contractual matters as required to support Company’s operations (including particularly advising on interpretation of contractual provisions, claims and correspondence)
  • Review standard contract documentation and procedures and identify, promote, negotiate, detail and implement improvements, liaising with other interested parties as appropriate
  • Represent Company’s Contracts function in meetings with external organizations
  • Provide first line technical supervision, coaching, mentoring and appraisal of less experienced personnel

Requirements

  • Knowledge and understanding of procurement processes including: ethical principles; bidder qualification; invitation to tender; comparative evaluation of contractors; and award, management, amendment and close out of contract
  • Appropriate practical experience in preparation and negotiation of complex technical contracts in the oil or petrochemical industries
  • Demonstrable general knowledge and understanding of the technologies utilized by oil and gas operators
  • Demonstrable general knowledge and understanding of commercial, legal and insurance issues affecting the Company in general, and in depth” understanding where relevant to contracts for works, goods and services
  • Extensive and detailed knowledge and understanding of model contract conditions in use by the Company with particular emphasis on the liability, indemnity and insurances regime applied by the Company
  • In depth knowledge and understanding of different means of contractor remuneration and their commercial implications, practical experience of their use, and sound ability to select and draft appropriate provisions
  • Basic understanding of the technical domain in which the job-holder’s clients operate
  • Understanding of the specific supply market relating to the domain in which the job-holder’s clients operate
  • General knowledge and understanding of Company’s business functions, with “in depth” understanding of the Contracts function and how it adds value, and a commitment to deliver added value
  • Ability and willingness to facilitate/chair any meetings required to conduct the activities of the job
  • Ability and willingness to effectively challenge the views of contractors and clients, and negotiate reasonable settlements whilst maintaining good relationships and sharing expertise and knowledge as appropriate
  • Ability and willingness to effectively coach and develop less experienced team members
